PRICES INCLUDE

Accommodation in the hotels mentioned in the itineraries or a substitute of the same or higher category, occupying rooms (single, double, triple, etc) according to the rates chosen, with private bath and taxes.  Board as indicated. Tours and excursions as mentioned. Transfers to and from the airport, stations and hotels when indicated.

The number of days’ accommodation arranged, taking into account that a hotel day starts at 3 pm and ends at 12 pm the next day, regardless of the arrival and departure time and its complete use or not. Tour duration is indicated in each case, considering the first day, the day of departure to the place of destination and the last day included in the tour, the day of departure from the place of destination, regardless of the time of arrival or departure on either day.

 

SERVICES AND OTHER ITEMS NOT INCLUDED

1) Extras, beverages, laundry service, tips, boarding fees, services fees, VAT and other taxes current and/or future,  or any other service except as otherwise expressly provided in the service order issued by the travel agent. 

2) Stays, meals and/or extra expenses or damages caused by cancellations, transport delays both incoming and outgoing or for unexpected reasons beyond our control. 

3) Meals in route, except as otherwise expressly provided in the programs.

4) The expenses and interests in credit operations.

 

RESTRICTIONS
The company reserves the right to require any person to withdraw from any tour due to health conditions or if we deem his acts or conduct offensive, dangerous or a nuisance to other passengers, or if it is incompatible with the interests, comfort, well-being or harmony of the group as a whole.

 

DOCUMENTATION
Traveling abroad requires to abide by the current legislation in each case. It is the agency’s inexcusable responsibility to inform faithfully and in advance of the requirements of the migration, customs and sanitary authorities in the destinations included in the tour. It is the passengers' responsibility to obtain and carry appropriate travel documents required by the authorities mentioned above.

 

CANCELLATIONS

1) In case of cancellation of credit operations, expenses incurred in advance such as reports, administrative fees, sealing charges, interests, etc. will not be refunded.

2) In case of cancellations affecting services already contracted by the agency, refunds will be subject to the contractual terms and conditions under which the respective companies operate.  In all cases of reimbursement, the agency will deduct the amount of expenses incurred in plus the agency’s 10% fee for outsourced services.

 

CHARTER TRANSPORT (NON REGULAR)
Charter transport is subject to the same conditions stated in the previous item. Notwithstanding, in these cases the reimbursement rate will be calculated only on the basis of the charges for land services (hotel, board, excursions) as determined by the organizer according to the operating procedures of each service provider.  For this clause to be valid, the quality of transport must be established in the first document delivered to the passenger.

 

ASSIGNMENT OR TRANSFER OF RIGHTS
The client may assign or transfer the rights arising from the contract up to 30 days before the departure date, provided that the transport agent, hotel or service provider have no objections. If the passengers were of different ages (minors or adults), the price will be subject to adjustments according to the price list.  In all cases of assignment or transfer, the company may charge an extra 10% over the agreed price.

 

LIABILITY
1) The company expressly declares that it is acting as a travel intermediary in the reservation or hiring of the different tourist services related to and included in the respective tour or service reservations: hotels, restaurants, transportation or other service providers. Notwithstanding, the company’s liability either as a travel organizer or as an intermediary will be subject to the provisions of the International Convention of Travel Contracts approved by Act 19.918.

2) The company assumes no liability for any events resulting from force majeur, acts of God, adverse climatic conditions or any other natural disaster that may take place before or during the development of the tour which may hinder, delay or interfere with the total or partial performance of the services governed by the contract, in accordance with the Civil Code.

ALTERATIONS OR CHANGES
1) The company reserves the right to completely or partially alter the daily organization and/or services integrating the tour, before or during the execution of the trip, for technical or operative reasons.

2) Unless otherwise stated, stipulated hotels could be substituted for others of equal or greater category within the same urban nucleus without charge to the passenger. In respect to these variations, the passenger will not have any right to compensation.

3) The company will be able to annul any tour when some of the circumstances anticipated in Art. 24 of the Decree 2182/72 take place.

4) Once the trip has begun, the suspension, modification or interruption of services on behalf of the passenger for personal reasons of any kind will not give rise to claim, reimbursement or return of any form.

 

ARBITRATION CLAUSE
All questions that arise in the occasion of the celebration, fulfillment, breach, extension or rescission of the present contract, will be subject to the resolution of the Arbitration Tribunal of the Argentine Association of Travel Agencies and Tourism and/or of the Arbitration Tribunals pertaining to the regional jurisdiction.  In this latter case, the contracting parties are subject to and accept all the terms and conditions established by the regulations of the Arbitration Tribunal.

 

 

APPLICATION NORMS

The present contract and, eventually, the performance of the services will be governed exclusively by these general conditions, by Act 18829 and its regulation by the Brussels Convention approved by Act 19918. The present general conditions together with the rest of the documentation delivered to the passengers conform the Travel Contract as established by the Convention.
